Client Guide

Welcome to Hak ve Hürriyet Avukatlık. This Client Guide is designed to help you understand what to expect when engaging our legal services, how to prepare for your consultation, and how we work together to achieve your legal objectives. We are committed to transparency, professionalism, and client empowerment throughout every stage of your legal journey.

By engaging our services, you acknowledge that all representation is subject to Turkish law, the regulations of the Istanbul Bar Association, and the terms of our written engagement agreement. This guide complements—but does not replace—your formal engagement agreement or the advice of your assigned attorney.

What to Expect When Engaging Our Firm

When you first contact Hak ve Hürriyet Avukatlık, our Client Care Team will gather basic information about your legal matter to determine the appropriate practice area and attorney assignment. You will then be scheduled for an initial consultation, which may be conducted in-person at our Istanbul office, via secure video call, or by phone, depending on your preference and the nature of your case.

During the consultation, your attorney will:

  • Listen carefully to your situation and objectives
  • Explain relevant Turkish legal frameworks and procedural options
  • Assess the strengths, risks, and potential outcomes of your matter
  • Outline a proposed strategy and estimated timeline
  • Discuss fee structures and provide a written engagement agreement if you choose to proceed

If you decide to engage our services, you will receive a formal engagement letter detailing the scope of representation, fee arrangements, communication protocols, and your rights and responsibilities as a client.

How to Prepare for Your First Consultation

To make the most of your initial consultation, we recommend gathering the following information and documents where applicable:

  • Personal Identification: Valid passport, Turkish ID (Kimlik), or residence permit
  • Case Documentation: Contracts, correspondence, court notices, police reports, medical records, or other relevant documents
  • Timeline Summary: A brief written chronology of key events related to your legal matter
  • Questions & Objectives: A list of specific questions you would like addressed and your desired outcomes
  • Financial Information: For matters involving damages, compensation, or business disputes, relevant financial records may be helpful

All documents can be uploaded securely via our encrypted client portal prior to your consultation. If you are unsure what to bring, our Client Care Team will provide personalized guidance when scheduling your appointment.

Understanding Legal Fees & Billing

At Hak ve Hürriyet Avukatlık, we believe in transparent, predictable fee structures. Depending on the nature of your matter, we may offer:

  • Hourly Rates: Billed in increments for time spent on research, drafting, communications, and court appearances
  • Fixed-Fee Packages: Predetermined fees for defined services such as document review, contract drafting, or uncontested matters
  • Contingency Arrangements: Where permitted by Turkish law and ethical rules, fees may be contingent upon successful outcome (typically in compensation or recovery cases)
  • Retainer Agreements: Advance payments held in trust and applied against future services, common for ongoing corporate or family law matters

All fees, billing cycles, and payment methods will be clearly outlined in your engagement agreement. You will receive itemized invoices detailing work performed, time expended, and expenses incurred. We accept bank transfers, credit/debit cards, and cryptocurrency payments where permitted. Questions about billing should be directed to your attorney or our Finance Team at billing@hak-hurriyet.com.

Your Rights as a Client

As a client of Hak ve Hürriyet Avukatlık, you have the following rights under Turkish law and the Istanbul Bar Association Code of Ethics:

  • Competent Representation: You have the right to diligent, knowledgeable, and ethical representation within the bounds of the law
  • Informed Consent: You must be fully informed of material developments, strategic options, risks, and costs before major decisions are made
  • Access to Your File: You may request access to your case file, subject to applicable privilege and confidentiality obligations
  • Termination of Representation: You may terminate our services at any time, subject to payment for completed work and reasonable notice
  • Complaint Resolution: You have the right to raise concerns internally or escalate to the Istanbul Bar Association Disciplinary Committee

These rights are non-waivable and form the foundation of our professional relationship. If you believe any right has been compromised, please contact our Compliance Officer at compliance@hak-hurriyet.com.

Communication Expectations

Clear, consistent communication is essential to effective legal representation. When you engage our firm:

  • You will be assigned a primary attorney and, where appropriate, a case manager as your main points of contact
  • We aim to respond to client inquiries within one (1) business day during office hours
  • Major case developments, strategy shifts, or settlement offers will be communicated promptly and in writing
  • You may contact your attorney via secure client portal messaging, email, or scheduled phone calls
  • For urgent matters outside business hours, please call 1234567890 and indicate "Urgent Legal Matter"

We encourage clients to maintain open communication, provide timely responses to requests for information, and notify us promptly of any changes to contact details or circumstances affecting your case.

Document Management & Confidentiality

All documents shared with Hak ve Hürriyet Avukatlık are handled with strict confidentiality and security:

  • Documents uploaded via our client portal are encrypted in transit and stored on KVKK-compliant servers
  • Access to your case file is limited to your assigned legal team and authorized support staff
  • We retain case files for the period required by Turkish law and Istanbul Bar Association record-keeping rules, after which they are securely destroyed or anonymized
  • Third-party service providers (e.g., translators, experts, process servers) are contractually bound to equivalent confidentiality standards

You retain ownership of your original documents. We will return originals upon request or at the conclusion of your matter, subject to our legal obligation to maintain certain records.

How Cases Progress Through the Turkish Legal System

While every legal matter is unique, most cases in Turkey follow a general procedural framework:

  1. Pre-Filing Assessment: Case evaluation, evidence gathering, and strategy development
  2. Filing & Service: Submission of petitions, complaints, or applications to the appropriate court or administrative body
  3. Discovery & Evidence: Exchange of documents, witness statements, expert reports, and other evidentiary materials
  4. Hearings & Proceedings: Court appearances, mediation sessions, or administrative hearings as scheduled
  5. Decision & Enforcement: Issuance of judgment, award, or administrative decision, followed by enforcement or appeal if necessary

Timelines vary significantly by case type, court workload, and procedural complexity. Your attorney will provide realistic estimates during your engagement and update you promptly if circumstances change. Appeals, enforcement actions, or cross-border elements may extend the duration of your matter.

What to Do If You Have Concerns

We strive to address client concerns promptly and professionally. If you have questions or feedback about your representation:

  1. Contact Your Attorney: Discuss your concern directly with your assigned attorney or case manager
  2. Escalate Internally: If unresolved, contact our Client Care Team at feedback@hak-hurriyet.com or call 1234567890
  3. Formal Complaint: For concerns regarding professional conduct, you may file a complaint with the Istanbul Bar Association Disciplinary Committee (contact details in our Complaints page)
  4. Data Protection Concerns: For issues regarding personal data handling, contact the Turkish Personal Data Protection Authority (KVKK) at www.kvkk.gov.tr

We take all feedback seriously and use it to improve our services. Your trust is our most valuable asset, and we are committed to earning it every day.
